TERMS OF SERVICES

1. GENERAL TERMS
→ To submit a commission inquiry, please contact me via Twitter.→ You as the client, are required to provide all necessary information and references for your request. Ensure that your description is clear and accompanied by suitable visual references.→ As the artist, I have the right to deny any commissions for any personal reasons.→ As the artist, I have the right to cancel a commission and offer a refund if I am unable to complete the order for personal reasons.

2. PAYMENT
→ Once the first or full payment is sent you are both aware and agree to my T.O.S. (Terms of Services).→ Payment for the commission must be made within 2 days (48 hours) after the commission is confirmed and accepted.→ As the artist, I will not begin making the commission until the payment has been transferred.→ Exceptions and payment plans can be made with further discussion.→ Please do not request a commission if you are unable to proceed with the payment.→ All conversion should be done automatically through Paypal so don't worry about that :)

3. WILL/WILL NOT DRAW
→ Below is a general guideline for what I will and will not draw. Please keep my art style in mind when ordering.→ As the artist, I will NOT try to match another artist's or company's art style (ex. Disney or Pokemon style etc).→ As the artist, I will offer a discount, or decline if I feel the request is out of my skill range or is made poorly by my standards.→ Feel free to ask for clarification!Allowed Content:

✕ Any sort of hateful content, such as racism, transphobia, homophobia, and characters with Nazi, Soviet, etc. imagery or paraphernalia.You must be over the age of 18 to commission adult/semi NSFW Content. By ordering anything NSFW, you are agreeing that you are at or above the age of 18.

4. REVISION AND DELIVERY
→ You, the client, will receive updates/WIPs of the piece and have the right to request any MAJOR changes and edits before the lineart stage. (ex. changing the outfit, placement of the pose/body parts etc.)→ Once we enter the lineart stage only MINOR changes can be made from there (colour adjustments, little details, adding small accessories etc.)→ Major changes during or after the lineart stage will come with an additional fee based on the scale of adjustments/changes.→ Please note that there is still a limited amount of major and minor changes you can make. Once you're close to the limit, you will be informed about it. If you wish to continue pass the limit an additional fee will be applied based on the scale of adjustments/changes.→ Once the commission is considered finished, there will be a 14 day grace period where you may request a limited amount of MINOR changes to the piece.→ If you, the client, wish to make major or minor changes after the 14-day check period, that change will require an additional fee based on the scale of adjustments/changes.→ If I, the artist, missed any details regarding your commission that you've informed me about BEFORE confirming the piece is finished, regardless if it's major or minor detail, you won't be charged for it.→ However if the piece is finished and there are details you've informed me about prior, minor or major changes, that are missing you have 14 days from when the piece is finished to bring up this concern. Otherwise there will be a additional fee based on the scale or adjustments/changes.→ The deadline is set prior to the payment process; this is decided between me, the seller, and you, the customer.→ By proceeding with the payment, you confirm that you are aware of and agree with the set deadline.→ Commissioned work will be sent to you via email. This will contain all the requested files.→ As the artist, I will not be making changes that you, the customer, have not agreed upon or weren't in the information you sent me upon receiving the request.→ As the artist, I ensure to communicate about possible delays, and other concerns regarding the commission.→ As the artist, I will decide what is considered major or minor changes.

5. COPY RIGHT AND USAGE
→ All artworks will include a subtle watermark that you are not allowed to remove.→ As the artist, I retain all copyrights over the commissioned work.→ As the artist, I can post the final version of the drawing on my social media and use it in my portfolio as a reference.→ If you, for any reason, would like me to not post it on my social media or stream the progress of your commission, please include that in the information for the request.→ As the artist, I will not further profit from the commissioned work.→ The client is not allowed to use the copyrighted work monetarily. This means making money off it in any way without paying the commercial fee.→ The client is allowed to use the artwork for personal use, social media, and print for personal use, as long as they are not creating monetary value from my work.→ There is no requirement to tag me if the art is being reposted on social media. It is, however, a requirement to visibly credit me as "IamNaivil".→ The client is not allowed to claim the artwork as their own.→ The client is not allowed to alter the artwork without my consent.→ The client is not allowed to trace or use the artwork as a reference UNLESS I, the artist, gave you, the client, permission and you visibly credit me.→ The client is not allowed utilizing the commission art for Stable Diffusion training (AI) purpose.→ The client is not allowed to utilize the commission art for NFT or Crypto/Bitcoin purpose.

6. CANCELLATION AND REFUND POLICY
→ Limited exceptions with refunds (further discussion needed) but generally no refunds.→ If the client commissions me, the artist, and files a chargeback, the client will be blacklisted (see #8 for blacklisted details).→ If 60 days have passed since the start of the commission without it being completed, the buyer may reach out to claim a refund. This depends on the agreement we come to.→ If the final product is delivered to the client within 2 months, no refunds are available.

7. COMMERCIAL USAGE
→ The client is allowed to use the artwork as a streaming asset (ex. emotes, alert badge, about me panels, stream banner, as their PNG model etc.) as long as I am visibly credited as "IamNaivil". (ex. in the description box or about me panel).→ Commissioning me, the artist, for any work does not allow the customer to use it for monetary purposes.→ For that to be allowed, a commercial fee will be added. The commercial fee is 25% of the price. A commercial fee will be added for every platform it intended to be used in (ex. Youtube + Merch = 50%)→ If the client is using it for commercial or monetary reasons, you must inform me, the artist, what platform(s) it will be used for.→ If you, the client, want unlimited commercial usage then the fee will be double the original price.→ The client may purchase the commercial rights to an artwork after it has been made.→ If the client is caught using any of my work for commercial use or monetary value WITHOUT paying the commercial fee the client will be blacklisted.

8. BEING BLACKLISTED
If the client go against ANY of the artist's T.O.S. the client will be blacklisted meaning...
→ The client will lose all rights to the image or any of its components and any usage or possession will be considered theft.→ The client will no longer have permission to commission me.→ Depending on the severity of your offense, I , the artist, will make it publicly known of the client's actions via social media.→ Other artists I know or friends with will be warned about you BUT it's up to them if they wish to still work with you or not.→ The client is no longer allowed to interact with me, the artist, by any means. (ex. on social media or streams, you will be blocked or banned depending on the severity of your offense.)
